These terms apply when you use boholaneaustralia.com.au or purchase from Boho Lane Australia. Our Privacy Policy, Shipping Policy and Refund and Returns Policy also apply. Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law (ACL).

Products and information

We sell fashion and related goods sourced from local and international suppliers. We take reasonable care with descriptions, images, sizing and availability. Colours and appearance can vary between screens. Any material error may be corrected, but this does not limit your rights where goods are incorrectly described or fail a consumer guarantee.

Prices and payment

Prices are shown in Australian dollars unless stated otherwise. The price payable is the price displayed and accepted at checkout, including any applicable shipping, taxes and unavoidable charges shown before payment. If a genuine pricing or availability error affects an order, we will contact you and offer an appropriate resolution, which may include cancellation and a full refund.

Orders

Submitting an order is an offer to purchase. We may decline or cancel an order for legitimate reasons such as stock unavailability, suspected fraud, an obvious pricing error or inability to deliver. If we cancel after payment, we will refund the affected amount to the original payment method. We will not cancel for an unlawful or discriminatory reason.

Delivery and risk

Delivery information is set out in our Shipping Policy. Risk in physical goods passes to you when the goods are delivered to you or a person you nominated, subject to applicable law. Carrier involvement does not remove any responsibility we have under the ACL.

Consumer guarantees and returns

Our goods come with statutory consumer guarantees, including that they are of acceptable quality, match their description and are fit for any disclosed purpose. Remedies depend on whether a failure is major or minor. Details and our change-of-mind rules are in our Refund and Returns Policy.

Acceptable website use

You must not misuse the website, interfere with its security or operation, introduce malicious code, scrape it unlawfully, impersonate another person or use it for fraudulent activity. Website content, branding and original materials are owned by us or used under licence and may not be commercially reproduced without permission, except as allowed by law.

Third-party services and links

Our store uses third-party services, including Shopify and payment providers, and may link to external websites. Their separate terms and privacy practices may apply. We are not responsible for external content we do not control, but this clause does not exclude liability that cannot lawfully be excluded.

Liability

To the maximum extent permitted by law, we exclude liability for losses that are indirect, consequential or not reasonably foreseeable. This limitation does not apply where liability cannot lawfully be excluded or limited, including liability arising under applicable consumer guarantees.

Changes

We may update these terms by publishing a revised version. Changes apply prospectively and do not remove rights attached to an order already accepted.

Governing law

These terms are governed by the laws of New South Wales, Australia. You may bring a claim in any court or tribunal that has jurisdiction under applicable law.
